Charlottesville Radio Group Inc. and First Systems & Resources and its subsidiaries and affiliated companies (together, the “Company”), will conduct the Contest substantially as described in these rules, and by participating, each participant agrees as follows:

ALL 106.1 The Corner WCNR GENERAL CONTEST RULES APPLY. 

You acknowledge and fully understand that by entering into this contest, you have agreed to be bound by the following terms and conditions. Your design should not be submitted if you are not in agreement with the following terms as your submission will constitute your acknowledgement of such agreement. Feel free to e-mail us with any questions concerning the foregoing terms:

The Company may conduct the Contest concurrently and simultaneously on several participating radio stations owned by the Company, and the Company may add or remove participating stations or change call letters of any participating station at any time during the Contest as announced on the affected station. 

1.          Original art submissions will be received to the station by form on the station website, hand delivery to the station physical address or by US Post.  All submissions must be received by 11:59 pm March 24, 2013. Finalists are chosen and on-line voting begins on or about March 25 and ends on or about 11:59 pm April 7, 2013.  The winning design will be announced on April 19th at Fridays After Five at the nTelos Wireless Pavilion. Winner does not have to be present to win.

A.             Dates of Contest:  The Contest will begin on or about March 11, 2013 and end on or about April 19, 2013.

NO PURCHASE NECESSARY.  PURCHASE DOES NOT INCREASE ODDS OF WINNING. Void where prohibited.  Odds of winning depend upon the number of participants.  Open to only legal U.S. residents who are of at least 18 years of age. All U.S. federal, state, local and municipal laws apply. Minors must have their parent or guardian's permission to enter by signing the agreement form.

B.             How to Enter: Beginning March 11 and ending 11:59 am March 24, 2013 listeners will be directed to go to 1061thecorner.com, hand deliver or US Post deliver to 1140 Rose Hill Drive, Charlottesville, VA 22903 to submit their original art design.  Valid contest entries must contain all information requested: Full Name, address, telephone number and the signed agreement form. Forms can be printed from 1061thecorner.com, obtained at the 106.1 The Corner studios and at the end of this document. Beginning on or about March 25 and ending 11:59 pm April 7, 2013 listeners will be directed to the 106.1thecorner.com to vote for their favorite design. The winning design will be announced on April 19 during the first Fridays After Five at the nTelos Wireless Pavilion. Winner does not have to be present to win.  Prizes may be picked-up at 1140 Rose Hill Drive, Charlottesville, VA beginning 8:00an on April 22, 2013.

C.             How to Play:  Of all entrees received 5 finalists will be chosen and notified by a panel of 106.1 The Corner and First Systems & Resources representatives on March 25, 2013. Beginning on or about March 25 and ending 11:59 pm April 7, 2013 listeners will be directed to the 106.1thecorner.com to vote for their favorite design. A final winner will be determined by both the number of on-line votes it receives and final decision of the 106.1 The Corner and First Systems & Resources panel. If the Station is unable to contact the winner with the information provided, the Station reserves the right to select another winner at its sole discretion.  The winning design will be announced on April 19 during the first Fridays After Five at the nTelos Wireless Pavilion. Winner does not have to be present to win. Should two or more finalists receive the same number of votes a winner will be determined by the decision of the 106.1 The Corner and First Systems & Resources panel.

2.             Prize(s).  The prize(s) that may be awarded to the eligible winner(s) are:

Qualifying Prize:                     Four (4) finalists receive a prize package from participating sponsors. Approx. Value: $200

Grand Prize:                            One winner receives one (1) iPad.  Approximate retail value: $499

The prize(s) that may be awarded to the eligible winner(s) are not transferable, redeemable for cash or exchangeable for any other prize.  Winner(s) must present state authorized identification prior to being awarded the prize.  All prizes or prize vouchers must be redeemed from the Station within 30 days of the contest end date unless stated otherwise in these official rules.  If a winner cannot be contacted or is disqualified for any reason, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion. 

3.             Eligibility and Limitations.  Participants and winner(s) must be U.S. (except CA) residents, at least 18-years old, as determined by the Company and have a legal I.D.  Only one (1) prize per household for the Contest for any thirty (30) day period.  Employees of the Company, the Contest’s participating sponsors and their advertising agencies, employees of other stations, and members of the immediate family of any such persons are not eligible to participate and win.  The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. Persons in any of the following categories are not eligible to participate or win a prize: persons who since January 1, 2012 were employees or agents First Systems & Resources,  Charlottesville Radio Group their respective parent companies, distributors, affiliates of any of the following organizations: (a) individuals engaged in the development of the production or distribution of materials for, or the implementation of, this sweepstakes; and (b) employees of, persons in the immediate family of, or persons living in the same household as any person in any of the proceeding categories.

4.             Telephone and Other Delivery Disclaimer.  The Company disclaims all liability for the inability of a participant to complete or continue a text call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Company’s control, or otherwise.  For all contests the Company disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method.  The Company is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including:  failed, incomplete, traffic congestion on telephone lines, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest. 

5.             Tampering and Delivery Disclaimer. (a) The Company, in its sole discretion, reserves the right to disqualify and prohibit from participating any person, who The Company determines (in its sole discretion) is or is attempting to: (i) tamper with The Company’s Website and/or any part of the Contest; (ii) attempting to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices, (iii) intending to annoy, abuse, threaten or harass any other participants or The Company’s Agents; and/or (iv) otherwise violating these Official Rules or the Terms of Use of The Company’s Website. (b) ANY ATTEMPT TO DELIBERATELY DAMAGE THE COMPANY’S WEBSITE (OR ANY PART THEREOF) OR UNDERMINE THE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, THE COMPANY AND ITS LICENSEES (IF ANY) RESERVE THE RIGHT TO SEEK DAMAGES AND ANY OTHER AVAILABLE REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. EACH ENTRANT (OR, IF THE ENTRANT IS NOT OF AGE OF MAJORITY IN HIS/HER STATE OF RESIDENCE, THE LEGAL GUARDIANS THEREOF) AGREES TO INDEMNIFY AND HOLD HARMLESS THE COMPANY AND ITS AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES AND/OR LIABILITIES (INCLUDING REASONABLE ATTORNEYS' FEES AND EXPENSES) THAT MAY BE ASSERTED AGAINST OR INCURRED BY ANY OF THEM AT ANY TIME, IN CONNECTION WITH THE USE THEREOF, AND/OR BY ENTRANT’S BREACHES OF ANY REPRESENTATION, WARRANTY OR COVENANTS ASSOCIATED WITH THIS CONTEST. If, in The Company’s opinion, there is any suspected or actual evidence of fraud, electronic or non-electronic tampering or unauthorized intervention with any portion of this Contest, or if fraud or technical difficulties of any sort (e.g., computer viruses, bugs) compromise the integrity of the Contest, The Company reserves the right to void suspect Entry and/or evaluations and/or terminate the Contest and award the Prize in its sole discretion. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter or evaluate repeatedly is prohibited. In the event of a dispute as to the identity of an entrant based on an email address, the entry in question may be disqualified. For all contests the Company disclaims all liability for any delays, missdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. The Company is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.

6.             Voting Contests. By participating in the voting portion of any contest, each voting participant agrees to be bound by the official contest rules. Voting is limited to one vote per person/verified email address. If an entrant receives multiple and/or irregular votes or multiple votes from the same user or users, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or other source, the Station reserves the right to disqualify the entrant in its sole discretion. If the contest includes the use of an internet tool and the internet voting process fails to operate properly or appears to be tampered with or tainted with errors, fraud or unfair practices, the Company reserves the right to use another means to determine the winner(s), i.e. random selection or appointing a panel of judges. All decisions of the judges are final.

7.             Publicity; Use of Personal Information.  By participating, where allowed by law, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use.  By participating in the Contest, where allowed by law, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.  By participating and accepting a prize, winner releases and agrees to hold harmless First Systems & Resources, Charlottesville Radio Group, their respective parent companies, distributors, affiliates and subsidiaries; the service agencies and independent contractors of any of the above organizations; and their respective directors, officers, employees, and agents, including advertising and promotional agencies, from any and all liability for any injuries including but not limited to, personal injury, bodily injury (including, without limitation, wrongful death), property damage, or loss of damage of any kind arising in whole or in part, directly or indirectly, from delivery/non-delivery, acceptance, possession, use, or misuse of the prize or from participation in this sweepstakes-related activity.

8.             Release.  By participating in the Contest, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. 

9.             Taxes.  Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law.  Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prizes which are not specifically provided for in the official rules.  Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded.  Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

10.           Conduct and Decisions.  By participating in the Contest, participants agree to be bound by the decisions of Company personnel.  Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified.  Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.  The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final.  If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate.  All decisions will be made by the Company and are final.  The Company may waive any of these rules in its sole discretion.  Any attempt by an entrant or any other individual to deliberately circumvent, disrupt, damage or undermine the legitimate operation of this Contest is a violation of criminal and civil laws. Should such an attempt be made, the Company reserve the right to seek civil and/or criminal prosecution and/or damages from any such person to the fullest extent permitted by law. 

11.           Miscellaneous.  Void where prohibited.  Odds of winning depend upon the number of participants.  Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize.  The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s).  The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest.  For a copy of the rules, or where required by law, a list of winners, visit the business office of the Station during normal business hours or visit the Station’s website.  The prize is non transferable. No cash or prize substitutions, except the Sponsor reserves the right to substitute prize of comparable value.

12.           Compliance with Law.  The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein.  Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.

Dear Contestant,

Please read, agree to and acknowledge the following:

A. I certify that the design I am about to submit is my original work and has never been copyrighted or, if copyrighted, that I am the sole copyright owner and am at least 18 years of age or am providing approval from parent or legal guardian to participate.

B. I am entering this design as an honest and true effort of my personal creativity and unique artistic vision, and I understand that:

(a) all material submitted will become the property of First Systems & Resources or its designees ("106.1 The Corner WCNR");

(b) the design that I am submitting shall be deemed a "work made for hire" (as defined under the United States Copyright Act and for the purpose of all other copyright laws throughout the world) created for First Systems & Resources. If, for any reason, said design, or any portion thereof, shall be adjudged not to be a "work made for hire," then I hereby irrevocably assign all rights of ownership in such design, including without limitation, all copyrights and all renewals and extensions thereof throughout the universe, to 106.1 The Corner WCNR;

(c) the design may be published in any manner or media now known or hereafter devised in connection with First Systems & Resources and its related endeavors and products, including on the Internet, in compact discs, DVDs or advertisements or in other promotions without compensation to me; and

(d) you will have no obligation to return the design to me.

C. I represent and warrant that:

(a) I have the full right, power and authority to enter into this agreement;

(b) no third party consents are required with respect hereto; and

(c) I waive any so called "moral rights" to the extent permitted by law. I agree that in the event of any dispute regarding the subject matter hereof, I will not have the right to seek injunctive relief or rescission in connection with the design, the results and proceeds of my submission hereunder and/or any exploitation, promotion, advertising and/or publicity thereof. I shall indemnify First Systems & Resources in connection with any claim arising out of any breach of my agreements, warranties, and/or representations made herein.

D. First Systems & Resources will have the right to (and authorize others to) publish, license, copy, modify, use, distribute or sell my submission in whole or in part for any purpose. Notwithstanding anything to the contrary contained herein, 106.1 The Corner WCNR reserves the right to use my name and address, without compensation, in any advertising or publicity, and 106.1 The Corner WCNR will not be liable for any failure to properly credit me in connection with the work.

E. The decision of the contest judges will be final and binding on all entrants. First Systems & Resources shall not bear any liability for the loss, theft or misuse of any prize or any property damage, personal injury or misfortune in any way attributable to this contest or the contest prizes. All taxes on prizes are the sole responsibility of the winner. Participation in the Contest constitutes your full and unconditional agreement to and acceptance of this official consent and agreement and acknowledgment of the foregoing. By entering the Contest, you warrant that the submission is an original work, has not been previously published or won any award, and that you are not aware of any conflicting rights in the submission including but not limited to copyright or other intellectual property right.
